With many in the bar scene grumbling over the smoking ban going into effect December 1st, and the inevitably approaching winter temps (although 70* today does provide some hope), we have to wonder if such a die-hard group of drinkers will shift to accommodate establishments which cater to the new requirements for indoor inhaling. As the new Virginia code rather clearly states:
Any portion of a restaurant that is constructed in such a manner that the area where smoking may be permitted is (i) structurally separated from the portion of the restaurant in which smoking is prohibited and to which ingress and egress is through a door and (ii) separately vented to prevent the recirculation of air from such area to the area of the restaurant where smoking is prohibited. At least one public entrance to the restaurant shall be into an area of the restaurant where smoking is prohibited.
We have been compiling a list of establishments which meet these criteria; however the ‘public entrance’ requirement knocks a few out of the running. Additionally, from having traveled to quite a few locations with indoor smoking bans, there are always proprietors willing to accept the risk of a $25 fine (businesses = per person smoking? / individuals = per cigarette you’ve been observed to smoke?). The code doesn’t clearly lay out the enforcement structure of these fines, although I’d imagine with 23 states having preceded us, there should have been ample code to plagiarize.
So, for those of us who continue to enjoy a little masochism with our mimosas, what locations are you betting will benefit from the new laws? [Photo Credits]

Wonderful, a post with dual purpose… showing the smokers where to go and the non-smokers where to avoid. Thanks cvillain!
It also provides eye candy. That’s like a triple whammy.
She looks real classy Ian… real classy.
That’s like a triple whammy.
More like a rippled tranny.
with a nippled fanny
A fickle nanny?
“pick up those toys, no, don’t pick them up, well, maybe…”
Shouldn’t it be: “70 degree temps HAVE been”?
Even your corrected version needs corrections. The most glaring error is that it should be “fewer” smokers, not less. Unless they were on those new Diet Cigarettes™. Low Calorie, High Fiber!
Even as a smoker i’m stoked.
Keep the government out of my lungs.
Miller’s Downstairs will be smoking too, after a little construction work. Only the 2nd floor will be non-smoking.
How is that possible? The 2nd floor would have to be totally closed off from the 1st and have its own entrance and completely separate ventilation…
You’ll see…it’s in the beginning stages now.
I can only imagine that the stairwell would have to serve as the new second floor entrance…
Yah, looks like it’s gonna be postponed for a while, though. Dang nab it.
To answer your grammatically incorrect question. I will be frequenting the smoker friendly establishments when not farming organically, being a vegan and proselytizing. Apologies to my regular ones, but goodbye through no fault of their own. Bars are just so health conscious. I’m sure most frequent them to get their daily dose of green green healthy, what w/ all of the granola and hypocrisy.
Maybe not Lazy Parrot…it may be a little too Greene.
at MAS we will comply with Caesar on December first, but allow smoking outdoors. this has been a long time coming from Richmond as we watched them wait until sufficient ass-cover was discovered for pulling the plug. bar sales versus healthcare costs for big corporations is the real culprit. they know you will still drink liquor even if you can’t smoke inside. after five cigarette sting attempts by the ABC at MAS, all unsuccessful, we decided to focus on our core mission rather than fight little nicotine skirmishes. the separate but equal scenario with ventilation is not doable, so smoke ‘em if you got em before coming inside. p.s. we’re working on our own “nicotini” to allay those withdrawal fears
Thanks for this post! Now I know where I’ll be going…
It appears as though Governor Kaine will be stopping by Hamilton’s tomorrow to kick off the ban. Perhaps we can lure him to Charlottesville’s new smokers haven, Millers, with a few Cuban cigars.
p.s. – Miller’s 3rd floor (the pool hall) will open @ 11:30 a.m. starting tomorrow.
Just got interviewed by channel 19 regarding my views about the ban.
Kind of enjoyed the set up at Miller’s last night- lots of pool tables, people! BTW- Thanks for providing the list- I was unaware that C&O still had smoking, looks like I’ll be checking them out as well.
Lazy Parrot is at least close to my office, but I don’t plan on hitting the corner.
Look for the opening of our new “smoker’s” speak easy, coming soon!
Hey Cvillian- I discovered much to my dismay on Friday during the blizzard that C&O should NOT be on the list.
Please tell me this isn’t real.
Charlottesville ASS Taskforce?
are you fucking kidding me?
Oh, nevermind. The Author is Alan Smithee.
